Challenges of International Humanitarian Law in Hybrid Warfare Conflicts

Contemporary armed conflicts are the result of the evolution of thousands of years in the practice of a human activity that has generated both contributions to the development of humanity and terrible tragedies that have demonstrated the brutality of war. Despite this, it has been possible to verify that consequences to the war, humanity has been able to advance in the construction of a legal framework that helps to mitigate it, and at the same time, to the construction of tools that help to consolidate the universal peace. However, the war actors have continued with the evolution of this, reaching the point of destabilizing their objectives without having to use the traditional methods of confrontation. For this reason, the purpose of this research is to determine which are the means and methods of contemporary actors in the context of Hybrid War against International Humanitarian Law-IHL. The methodological approach of the research is qualitative, using theoretical and bibliographical analysis as the primary tool, triggering the examination of three case studies to achieve the objective. The main finding of the investigation is to determine that the means and methods of confrontation have drastically changed, making it impossible, to a large extent, the principle of distinction within the framework of IHL. At this point, the document contributes to the fact that there is an empty space in the framework of IHL in the face of this type of confrontation, limiting its purpose.
